PREVIOUS PROCEDURES FOR FILING AN ADMINISTRATIVE APPEAL AND THEIR IMPACT ON THE CONTESTED DECISION (A COMPARATIVE STUDY)

When filing an administrative case before the competent Court, the claimant must follow some obligatory legal procedures. Failure to follow them results in the non-acceptance of the administrative appeal, and these legal procedures are an objective condition and one of the rules of public order, and therefore the court before which the administrative appeal is submitted cannot proceed with it unless The availability of following these procedures, not following them leads to very important legal implications. This scientific paper deals with a legal and judicial problem, which is how to address the effects of management actions that harm the citizen? In particular, in those countries that do not have the so-called State Council judiciary, which is an independent judiciary that control the work of the administration. This research paper is entitled: Previous procedures for filing an administrative appeal and its impact on the contested decision( A comparative study) with an introduction that contains the importance of the research, its problem, the comparative analytical positivist methodology, the previous studies and the structure of the research. In the first topic, the research deals with the concept of the administrative lawsuit and the judiciary concerned with it, in the second one deals with the legal procedures to be followed to file the administrative appeal, in the third it deals with the effects of following or not following the procedures required to file the administrative lawsuit, and it concludes with results and recommendations.
